Italy made history by becoming the first European Union member state to pass a comprehensive national AI law. This legislation not only complements the EU’s Artificial Intelligence Act but also introduces unique national provisions that address Italy’s specific socio-economic context. The law establishes a robust framework for AI development, deployment, and governance, emphasizing human-centric principles, transparency, and accountability. It spans critical sectors such as healthcare, the workplace, education, justice, and public administration, setting a precedent for other nations grappling with the complexities of AI regulation.

  • National Governance Framework: The law establishes a composite governance system. The Agency for Digital Italy (AgID) and the National Cybersecurity Agency (ACN) serve as lead authorities, overseeing notifications, safe AI use, and system Transition and the Observatory on AI adoption in the workplace, provide oversight on national strategy and labor market impacts. In healthcare, the National Agency for Regional Health Services, in consultation with the Garante, manages data guidelines and synthetic data creation. 
  • Server and Data Location Rules: AI systems may be hosted outside the EU, providing flexibility for cloud infrastructure, but public administration procurement favors suppliers that localize strategic data in Italian data centers and ensure disaster recovery continuity domestically. 
  • Workplace Protections: Organizations using AI for production or management processes must ensure systems respect worker privacy, safety, and equality, avoiding discrimination. Employees must be informed when AI is deployed, ensuring transparency in organizational processes. 
  • Healthcare and Research: The law supports scientific research using personal and health data, with simplified patient notification requirements. Secondary use of data is permitted when de-identified, anonymized, pseudonymized, or synthesized, enabling research and healthcare management while safeguarding privacy. 
  • AI and Minors: Children under 14 may only access AI systems with parental consent, which also extends to the processing of their personal data. This ensures that minors are protected both in terms of access and privacy. 
  • Criminal Liability: The law introduces penalties for AI misuse, including imprisonment for individuals who cause unjust damage by distributing misleading AI-generated content, such as altered images or videos. Transparency obligations are emphasized to prevent deception.

  • Cultural factor: Italian policymaking has often emphasized protecting individuals from unchecked technology use, whether in privacy, workplace protections, or consumer rights. The AI law continues this tradition by prioritizing safeguards alongside innovation.

Italy’s AI law doesn’t exist in a vacuum. Its approval sends ripples far beyond national borders, raising questions about how other countries and regions might respond. By moving first, Italy has positioned itself as a regulatory trailblazer, showing that it is possible to combine rules with innovation rather than leaving AI entirely ungoverned. EU AI Act: Mandates transparency obligations for AI systems, including providing users with clear information about the AI system’s capabilities and limitations. High-risk AI systems must ensure human oversight to mitigate risks.

Italy’s AI Law: Strengthens these requirements by specifying that AI systems must be developed and applied while respecting human autonomy and decision-making power. It also mandates traceability of AI decisions across sectors like healthcare, education, and public administration.  

Data Protection Privacy 

EU AI Act: Integrates with the EU General Data Protection Regulation (GDPR), ensuring that AI systems comply with data protection principles.

Italy’s AI Law: Aligns with the GDPR and introduces additional safeguards. For instance, it requires that children under 14 must obtain parental consent to access AI systems, enhancing privacy protections for minors. 

Criminal Liability 

EU AI Act: Imposes penalties for non-compliance, including fines up to €35 million or 7% of global annual turnover for certain infringements.

Italy’s AI Law: Introduces specific criminal penalties, including imprisonment for individuals who cause harm through AI-generated content, such as deepfakes. This provision aims to address emerging threats in digital content manipulation.  

Sectoral Oversight 

EU AI Act: Establishes a European Artificial Intelligence Board to promote national cooperation and ensure compliance with the regulation. National authorities are responsible for enforcing most parts of the regulation.

Italy’s AI Law: Designates national bodies such as the Agency for Digital Italy and the National Cybersecurity Agency to oversee AI development and implementation. These agencies are tasked with ensuring that AI systems adhere to national standards and regulations. 

Next Steps for Businesses 

While in the short term, only the businesses operating in or with Italy must adapt to new compliance obligations, the long-term effects may influence businesses engaged with in other EU countries as well.
