Four Risk Categories & Fines

The EU AI Act classifies AI risks into four main categories. Get an overview of these risk categories, their impact, and penalty structure.

Minimal

  • No human intervention is required 
  • E.g. AI-enabled video games and spam filters 
  • No fines as of now 

Limited

  • Focusing on transparency & alerting users about AI use
  • E.g., Deep fakes and chatbots
  • Fines: Up to 1.5% of annual revenue or 7 million euros

High

  • AI programs used in transport, education, health, safety, and act enforcement
  • E.g., surgery with AI or self-driving cars
  • Rigorous risk assessments, high-quality datasets, maintaining activity log, providing comprehensive documentation, ensuring clear information & human oversight 
  • Fines: Up to 3% of annual revenue or 15 million euros

Unacceptable

  • Prohibited AI systems due to conflicts with EU values and fundamental rights, including the rights to privacy, data protection, and non-discrimination
  • E.g., social scoring individuals on particular behaviors and physical & emotional traits
  • Fines: Up to 7% of annual revenue or 35 million euros, whichever is higher
