Sector-Specific AI Governance: Reshaping Governance Around Healthcare Access

Healthcare has a way of exposing the limits of generic governance. When AI influences who gets screened, diagnosed, treated, or approved for care, “standard controls” stop feeling sufficient. With HHS’s 2024 Section 1557 final rule, healthcare providers receiving federal funding must ensure that AI and clinical decision support tools do not result in discrimination based on race, color, national origin, sex, age, or disability. This requirement signals something larger than a compliance update. It reflects a regulatory recognition that AI in healthcare operates in a uniquely high-stakes environment where algorithmic bias directly impacts access to care, treatment pathways, and patient outcomes. 

As providers expand their use of AI in screening, diagnosis, treatment planning, and medical necessity determinations, governance must move beyond generic AI controls toward healthcare-specific safeguards. 

When Algorithms Influence Access to Care 

Being sector-specific does not mean abandoning general AI governance principles. It means adapting them to a context where decisions influence patient safety, reimbursement eligibility, and protected health outcomes. Healthcare AI introduces risks that generic governance models often fail to address adequately: 

  • Embedded Bias in Clinical Decision Support: AI systems trained on historically skewed clinical datasets may inadvertently reinforce disparities in diagnosis or care allocation. In healthcare, these biases may delay treatment, misprioritize patients, or limit access to specialized care. 
  • Medical Necessity and Coverage Determinations: When AI influences prior authorization or medical necessity decisions, it directly affects whether a patient receives care. Governance must ensure that automated tools do not create systemic discrimination or opaque denial patterns. 
  • Interoperability Across Clinical Systems: Healthcare AI tools often integrate into EHRs, imaging platforms, revenue cycle systems, and third-party analytics engines. Without sector-specific oversight, discriminatory patterns may propagate silently across systems. 
  • Diffused Accountability Between Providers and Vendors: AI tools in healthcare are frequently developed by third parties but deployed within provider workflows. Section 1557 makes clear that liability does not disappear through vendor reliance. Governance must clearly define responsibility for validation, monitoring, and remediation. 
  • Heightened Enforcement and Reputational Exposure: Healthcare institutions operate under layered regulatory regimes (OCR, CMS, state regulators, accreditation bodies). AI-driven discrimination risks not only civil penalties but also institutional trust and patient confidence. 

Recalibrating AI Governance for Healthcare 

The 2024 Section 1557 rule reframes AI in healthcare as a civil rights issue. That shift requires governance models calibrated to healthcare realities. Sector-specific AI governance in healthcare providers should include: 

  • Comprehensive AI Use Case Inventory: Healthcare organizations need a living inventory of where AI influences clinical, operational, or administrative decisions particularly those affecting protected classes. This means documenting not just the existence of AI tools, but how they are used, the level of decision authority they carry, which patient populations they impact, and where outputs feed into diagnosis, treatment, or coverage determinations.  
  • Discriminatory Risk Assessment: Risk assessments must evaluate potential disparate impact across race, ethnicity, sex, age, disability status, and other protected categories. Technical accuracy metrics alone are insufficient. Governance should examine whether training data reflects historical inequities, whether proxy variables introduce hidden bias, and whether error rates disproportionately affect certain populations. 
  • Continuous Monitoring of Clinical Outputs: Healthcare AI systems require ongoing oversight, not one-time validation. As patient populations, clinical protocols, and reimbursement standards evolve, organizations must monitor for drift, emerging bias, and unintended consequences. Continuous review of outcomes, override patterns, and performance disparities ensures that systems remain aligned with both clinical standards and anti-discrimination obligations. 
  • Defined Escalation and Human Review Mechanisms: When AI outputs influence diagnosis or medical necessity decisions, meaningful human oversight must be embedded into workflows. Clear ownership, override authority, escalation pathways, and documentation requirements are essential.  
  • Vendor Governance and Contractual Controls: Because many healthcare AI systems are vendor-supplied, governance must extend beyond internal controls. Providers should require transparency into testing methodologies, bias mitigation efforts, and performance metrics, along with contractual clarity around monitoring and remediation responsibilities.  

Innovation with Accountability 

AI healthcare affects efficiency, equity, safety, and access to care. The Section 1557 rule makes clear that AI-driven discrimination is not an acceptable byproduct of innovation. Governance must ensure that clinical AI systems are designed, deployed, and monitored in ways that protect patients’ civil rights and uphold institutional accountability.
