Peloton, a well-known exercise bike manufacturer, has recently been embroiled in a class-action lawsuit for allegedly violating the California Invasion of Privacy Act (CIPA). The crux of the issue lies in Peloton’s use of AI-operated chat services provided by the marketing firm Drift. According to the lawsuit, Drift recorded and analyzed chat data between Peloton users and company representatives without user consent. This case underscores the importance of obtaining explicit user permission before processing sensitive information and highlights the potential consequences of neglecting AI governance.
This is a wake-up call for companies – plaintiffs are going to leverage existing laws, even before the myriads of AI legislative efforts come to fruition. These laws may be tailored to privacy including data sharing, discrimination under Title VII, or wiretap laws. AI is not a free pass while regulations are still being passed and coming into effect in the future. We saw plaintiffs explore the wiretap law, as related to privacy in general, with little success.
